What you should know

Lease basics every state requires

Names of all tenants and landlord, property address, term length (start and end date), monthly rent, security deposit amount, payment due date, late-fee policy, lead-paint disclosure (federal, properties built before 1978), and signatures from all parties. State-specific addenda may apply (CA: bedbug disclosure; NY: lead-paint window guards; FL: radon disclosure).

Both parties usually sign

Add yourself (landlord) as a recipient and the tenant(s) as additional recipients. For shared housing, add every adult tenant — courts treat all named tenants as jointly liable.

Co-signers and guarantors

Some leases require a guarantor (parent for student tenant, etc.). Add them as a third recipient with their own signature field. The guarantor's signature line typically reads 'Guarantor' rather than 'Tenant'.

Lease counts as a contract

Same legal framework as any e-signed contract — U.S. ESIGN Act and state Uniform Electronic Transactions Acts. Standard electronic signatures are enforceable for residential leases in all 50 states except in narrow Vermont edge cases.

Do I need to print the signed lease?
